Procedures by Which Officials with Special Service Ranks of the State Border Guard, State Police and State Fire-fighting and Rescue Service Shall Be Seconded for Participation in International Missions and Operations, and the Procedures for Financing the Participation

Border Guard Law, Section 8, Paragraph three
of the Law On Police and
Section 23.1, Paragraph three of the
Fire Safety and Fire-Fighting Law

1. These Regulations prescribe the procedures by which officials with special service ranks (hereinafter - officials) of the State Border Guard, State Police and State Fire-fighting and Rescue Service (hereinafter - authority) shall be seconded for participation in international missions and operations, and the procedures for financing the participation.

2. Officials shall participate in international missions and operations according to the resolutions, recommendations or requests of the international organisations, associations or Union with which the Republic of Latvia has entered into international agreements.

3. Officials shall participate in international missions and operations voluntarily.

4. Candidates for the participation of officials (including Border Guard officials (dog handlers), who fulfil the duties of office together with a service dog) in international missions and operations shall be nominated by the head of the authority.

5. An official shall be seconded for participation in an international mission or operation if he or she conforms with the following requirements:

5.1. the official has received an opinion of the Central Medical Expert Examination Commission of the Ministry of the Interior regarding the conformity of the condition of health for the participation in a specific international mission or operation;

5.2. the official has a good command at an appropriate level of the foreign language required for the participation in a specific international mission or operation;

5.3. the qualification of the official conforms with participation in a specific international mission or operation; and,

5.4. the official has served in the authority for at least five years.

6. An official (dog handler) of the State Border Guard who fulfils the duties of office together with a service dog, shall be seconded for participation in an international mission or operation, if he or she conforms with the requirements specified in Paragraph 5 of these Regulations and the service dog is trained for a specific specialisation and the capacity for work conforms with the class of utilisation or the master class.

7. The following shall be indicated in a Cabinet Order regarding the participation of an official in an international mission or operation:

7.1. the given name, surname and position of the official;

7.2 the time of participation of the official in an international mission or operation;

7.3 the co-efficient (from 1 to 1.8) for calculating supplements for participation in an international mission or operation; The co-efficient shall be determined, observing the following criteria:

7.3.1. the possibility of a terrorism threat;

7.3.2. the possibility of an ethnic or other type of armed conflict arising;

7.3.3.ecological conditions (for example, the level of pollution, the potential radioactive or chemical pollution and the potential for a technological disaster;

7.3.4 the type of the relevant international mission or operation and duties to be performed (for example, monitoring, provision of aid, prevention of conflict or the takeover of functions of a law enforcement authority);

7.3.5 the conditions of housing, residence and service during the period of an international mission or operation; and,

7.4 the name and microchip number of the service dog, if a border guard (dog handler) is seconded to an international mission or operation together with a service dog.

8. The Cabinet may extend the period of participation of an official in an international mission or operation with a separate order.

9. An official shall be recalled from participating in an international mission or operation by Cabinet in the following cases:

9.1 the official has committed a criminally punishable offence;

9.2 the official has committed a disciplinary violation of service which is not compatible with the subsequent participation in an international mission or operation;

9.3 due to the state of health of the official;

9.4 the recalling of the official is requested by the management of the international mission or operation;

9.5 in the cases specified in Paragraph 10 of these Regulations; or,

9.6 due to the state of health of the service dog of a border guard (dog handler).

10. An official may refuse further participation in an international mission or operation as follows:

10.1 of his or her own volition, with notification of this one month in advance;

10.2. due to the state of health; or,

10.3 due to other objective conditions which are not compatible with the further participation in an international mission or operation.

11. An official, when participating in an international mission or operation, shall receive a supplement in the amount of LVL 1 000 in addition to the specified salary thereof, which shall be multiplied by the co-efficient specified in the Cabinet order.

12. During the period of an international mission and operation an official shall retain the social benefits for officials specified by the regulatory enactments of the Republic of Latvia.

13. An authority shall cover the following expenses connected with the participation of an official in an international mission and operation from the funds provided in the budget thereof:

13.1. visa processing expenses;

13.2 life and health insurance expenses, not exceeding LVL 1 800 a year for each official;

13.3 travel expenses to the location of the international mission or operation and back, in accordance with the documents submitted confirming these expenses. If an official uses an aeroplane, travel expenses shall be covered, not exceeding the amount of the price of an economy class flight ticket;

13.4 expenses for the purchase of a uniform, the necessary equipment and armaments;

13.5 vaccination expenses against those diseases against which vaccination is necessary in the territory in which an international mission or operation is intended;

13.6 the specified daily allowance in accordance with that specified in the Annex to these Regulations according to the location of the international mission or operation;

13.7 compensation for the expenses of rent and communal services of an apartment (residential premises). The amount of expenses shall be determined in accordance with the Annex to these Regulations, in complying with the following conditions:

13.7.1 if the actual expenses for the rent and communal services of an apartment (residential premises) are less than the amount of expenses specified, the actual expenses shall be covered for the official;

13.7.2 with the entering into a rental contract for an apartment (residential premises), the expenses connected with the real estate agent services shall be covered in accordance with the documents submitted, not exceeding the amount of the expenses for rental for three months;

13.7.3 if it is not possible to prove the actual expenses for the rent or communal services of an apartment (residential premises), the expenses referred to shall be covered based on the notification of an official which shall be approved by the head of the authority, but not exceeding the amount of expenses specified in the Annex to these Regulations;

13.8 expenses for the transportation and upkeep of a border guard (dog handler) service dog, expenses for the purchase of necessary equipment and stock, expenses for vaccination and veterinary services, if a border guard (dog handler) is seconded for participation in an international mission or operation together with a service dog;

13.9 other actual expenses connected with the fulfilment of duties of an official in an international mission or operation in accordance with the documents submitted, which confirm those expenses, if, after evaluating the documents submitted, the head of an authority agrees that the expenses are connected with the fulfilment of the duties referred to and takes a decision regarding reimbursement of the expenses.

14. An authority shall cover the expenses specified in Paragraph 13 of these Regulations, if in accordance with the conditions of financing of an international mission or operation the covering of these expenses or part thereof is in the competence of the Republic of Latvia.

15. An official may be seconded for participation in an international mission or operation again, not earlier than after one year.

16. The deadline specified in Paragraph 15 of these Regulations shall be calculated, from the day that the official returns from an international mission or operation.

17. Following the return from participation in an international mission or operation, an official has the right to take up the previous or an equivalent position thereof.

18. The amount of costs referred to in Paragraph 11, Sub-paragraphs 13.6 and 13.7 shall be reviewed by Cabinet each year starting from 2009 by 31 December.

19. Cabinet Regulation No. 422 of 23 may 2006, Procedures, according to which Border Guards and Police Officers shall be seconded for Participation in International Missions and Operations, as well as Procedures for Financing the Participation, is repealed (Latvijas Vēstnesis [official Gazette of the Government of Latvia], 2006, No.81).
