Regulations Regarding Special Connection to the Electricity Transmission System

Issued pursuant to
Section 9, Paragraph three of
the Electricity Market Law

I. General Provision

1. These Regulations prescribe the procedures, by which an application of an end user for the establishment of a special connection to the electricity transmission system (hereinafter - a connection) or an amplification of the existing connection capacity is submitted and examined if the electricity consumption of such user will not be less than 100 000 megawatt hours per year or the nominal connection power will not be less than 50 megawatts, the procedures for the connection installation and the required guarantees of the end user regarding the use of the connection.

II. Procedures for the Submission and Examination of an Application for the Installation of a Connection

2. For the installation of a connection an end user shall submit to an operator of the electricity transmission system (hereinafter - a system operator) the following documents:

2.1. a completed application form (Annex 1);

2.2. a copy of the registration certificate of the merchant; and

2.3. a description and plan or map of the geographical location of such planned object to be newly built, for the electricity supply of which it is necessary to install the connection.

3. After the receipt of an application a system operator shall:

3.1. determine the location of the connection, from which it is possible to supply electricity of the required quality to an end user for optimum costs, and issue the technical regulations for the establishment of such connection. Technical regulations shall be clear, unequivocal, technically justified and sufficient so that in case of technological interruptions the renewal of the electricity supply is ensured in the connection site not later than within a time period of 12 hours; and

3.2. calculate the approximate costs of construction of the connection, specify more precisely the conditions, possibilities and terms for installation and inform the end user about it in writing within a time period of 60 days.

4. If the information indicated in the documents submitted by an end user is not sufficient or precise, the system operator may request additional information from the end user. The activities referred to in Paragraph 3 of these Regulations shall be performed after the receipt of all the necessary information or documents. The time period until the receipt of the necessary information or documents shall not be included in the term specified in Sub-paragraph 3.2 of these Regulations.

5. After the receipt of the technical regulations for the establishment of a connection, an end user shall submit to the Ministry of Economics (hereinafter - the Ministry) a submission. The following shall be attached to the submission:

5.1. a completed application form (Annex 2);

5.2. a copy of the registration certificate of the merchant;

5.3. a description and plan or map of the geographical location of such planned object to be newly built, for the electricity supply of which it is necessary to install the connection;

5.4. the technical regulations for the establishment of the connection issued by the system operator; and

5.5. a written confirmation regarding the amount of electricity consumption or value of the nominal connection power after the installation of the connection.

6. An end user shall certify that:

6.1. the specified amount of annual electricity consumption or value of the installed power will be reached not later than within a time period of 2 years after the installation of the connection;

6.2. the specified amount of annual electricity consumption or value of the installed power will not be reduced during at least 8 years.

7. The Ministry, within a time period of 30 days after the receipt of the submission referred to in Paragraph 5 of these Regulations, shall prepare a draft of Cabinet Regulations regarding the application of connection conditions, including the connection fee part, which shall be covered by the end user and which is calculated in accordance with the methodology for calculation of the connection fee specified by the Public Utilities Commission (hereinafter - the regulator).

8. Any electrical installations, which are installed on the end user's side behind the proprietary border between the electrical installations that are owned, possessed or used by the system operator and the end user, shall be the property of the end user, and the end user shall pay for the installation thereof.

III. Procedures for the Installation of a Connection

9. A system operator, upon a written agreement with an end user, shall organise the development of a connection project. The development of the connection project until the planned proprietary border of the end user's electrical installation shall be paid from the funds of the end user. The end user himself or herself has the right to organise the development of such project, co-ordinating the costs of the project with the system operator.

10. Within a time period of 3 weeks after accepting of the project of a connection construction in accordance with the procedures specified in the Construction Law and the co-ordination thereof with the end user, the system operator in accordance with the procedures specified in regulatory enactments shall initiate:

10.1. the procedure for selecting the suppliers of the electrical installations and materials necessary for the installation of the connection; and

10.2. the procedure for selecting the candidates for the performance of the construction works necessary for the installation of the connection.

11. A system operator shall apply a method - an open tender - for the selection of candidates and selection of tenders. The system operator shall publish the information regarding the tender on the Internet home page thereof on the day of the announcement of the tender.

12. The end user, during the period of the specified selection of candidates, has the right to receive information regarding the candidates who have submitted tenders, criteria for the selection of candidates and the proportion thereof in the evaluation, to participate in the evaluation and to get acquainted with the tenders submitted, the prices thereof and justification for the selection of the candidate. The end user is entitled to express his or her opinion regarding the selection of candidates only in relation to compliance or non-compliance with the criteria approved for the selection of candidates.

13. A system operator:

13.1. shall select the candidate for the construction of the connection not later than within a time period of 2 months after the opening of the tenders submitted by the candidates;

13.2. shall enter into a connection contract with the end user, taking into account the tender submitted by the candidate for the construction of the connection, as well as the suppliers of the necessary electrical installations and materials. The amount of the connection fee and payment term, as well as the term for the installation of the connection in accordance with the tender submitted by the candidate selected for the construction of the connection shall be determined in the connection contract;

13.3. after entering into the connection contract, shall enter into contracts with the candidate for the construction of the specific connection, as well as the suppliers of the necessary electrical installations and materials;

13.4. in accordance with the provisions of the connection contract, shall organise works for the installation of the connection as far as the proprietary border of the end user's electrical installation; and

13.5. after construction of the connection and putting into service thereof not later than within a time period of 20 working days shall connect the electrical installations of the end user to the electricity supply network in accordance with the conditions of the connection contract of the system operator and end user.

14. The electricity supply network, which is installed for the electricity supply of an end user, shall be the property of the system operator.

15. The system operator shall install an electricity meter for the commercial accounting of electricity or a system of electricity meters for the accounting of the electricity amount for the commercial settlement of accounts on the proprietary border of the end user's electrical installation. The costs for the installation of the meter or the system of meters shall be included in the calculation of the connection fee.

16. The system operator shall provide the regulator with information regarding the complete costs of the connection performed and the connection fees received from the end users (per each accounting year).

17. If an end user covers all the costs related to the installation of the connection, after co-ordination of the selection criteria with the system operator, he or she has the right to organise the development of a project for the installation of the connection, to select the supplier of the electrical installations and materials necessary for the installation of the connection and the construction merchant for the performance of the construction works of the connection.

18. The system operator shall enter into a connection contract with the end user, taking into account the tender submitted by the candidate for the construction of the specific connection, as well as the suppliers of the necessary electrical installations and materials selected in accordance with the procedures specified in Paragraph 17 of these Regulations. A term for the installation of the connection shall be determined in the connection contract in accordance with the tender submitted by the candidate selected for the construction of the connection.

19. If a connection is performed in accordance with the procedures specified in Paragraph 17 of these Regulations, the requirements specified in Paragraphs 5, 6, 7, 9, 10, 11, 12, 13 and 14 of these Regulations shall not apply thereto.

IV. Other Conditions for the Installation of a Connection

20. The costs for the installation of a connection to the electricity supply network, which are not covered by an end user in accordance with the methodology for calculation of the connection fee specified by the regulator, shall be included in the costs, which form the electricity transmission tariff.

21. The payment fee to an end user who requests a connection to an electricity supply network of 110 kilovolts and higher voltage, but does not comply with the criteria specified in Section 9, Paragraph three of the Electricity Market Law, shall be determined equivalent to the actual design and construction costs.

22. A system operator shall publish the information regarding average costs of transmission electricity supply network, calculations of the connection fee and average time periods for the installation works in the preceding calendar year on the Internet home page thereof by 1 April of the following year, so that the end user, when submitting the application referred to in Annex 1 of these Regulations, could forecast the costs for the construction of the connection and average time periods for the installation works.

V. Guarantees of an End User Regarding the Utilisation of the Connection

23. An end user shall be responsible for the veracity of the information provided by him or her as regards the amount of consumption of electricity, the volume of power installed and other criteria taken as the basis in determining the procedures for the installation of the connection for the particular end user.

24. An end user shall cover all the expenditure of the system operator related to the installation of the connection if:

24.1. within a time period of 2 years after the installation of the connection, the amount of annual consumption of electricity or the volume of installed power specified by the Cabinet has not been reached; or

24.2. after the installation of the connection, the amount of annual consumption of electricity or the volume of installed power specified by the Cabinet is used for less than 8 years.

25. If an end user refuses from the further installation of the connection during the implementation of the connection, he or she shall cover any actual expenditure of the system operator until the discontinuance of the project. Money paid for the development of the project shall not be repaid.

26. Disputes regarding the installation of the connection shall be examined in accordance with the procedures specified by the Law On Regulators of Public Utilities.

11. In the Annex:

12. Reference of the transmission system operator:

12.1. the connection contract shall be drawn up within a time period of 3 months from the day of the submission of the application;

12.2. the design and assembling works shall be carried out in compliance with the requirements of the Construction Law, Latvian Building Standards (LBS), regulatory enactments, provisions and standards;

12.3. the Network Code shall be binding to the candidate of the connection;

12.4. the transmission system operator, after entering into the connection contract, shall issue a design task within a time period of 15 working days, if additional information is not necessary;

12.5. the candidate of the connection, in selecting the organisation of design, shall invite a representative of the transmission system operator.
